The Department of Labor has posted on its website an informational booklet entitled “The Employer’s Guide to The Family and Medical Leave Act” which provides details regarding an employer’s obligations to employees who need FMLA leave, recordkeeping requirements, and the interaction of the FMLA with other laws. The guide contains the essential information about the FMLA, is written in a form easily understandable by all, and includes illustrations and examples. However, it does not address some of the more unusual situations that we have encountered with regard to FMLA leave.
Nonetheless, the guide appears to be a good step in assisting employers who may have questions about particular FMLA issues and provides a good overview of the law for those unfamiliar with its provisions. In addition, the new “Employee Rights” notice posted on the department’s website is easier to read and more visually appealing than the prior notice, though employers are free to keep posting the poster issued in 2013 or replace it with the new poster.
