We draw upon our extensive experience when addressing union issues for health care clients. Examples of our experience include assisting a client through the organizational activities relating to a 1,500 person collective bargaining unit, eventually negotiationing and renegotiationing the related collective bargaining agreement, grieving and arbitrating claims under the collective bargaining agreement, handling a decertification petition, addressing work actions while maintaining high-quality patient care, and defending against unfair labor practice claims.
When litigating discrimination claims for health care clients we can draw upon our understanding of defenses that may be available to religiously sponsored organizations, the unique clinical and operational settings in which the alleged act may have occurred and a thorough understanding of physician / medical staff / health care provider / nursing / patient relationships.
When providing transactional services for health care clients we utilize our comprehensive understanding of the Federal Anti-Kickback Statute and Physician Self Referral Law, not-for-profit and tax-exempt regulations, antitrust guidelines and unique state laws governing health care.
Examples of other health-care specific services we provide include: facilitating the formation of physician / hospital joint ventures to provide services such as diagnostic imaging services, cardiac catheterizations and ambulatory surgery services, drafting and reviewing physician recruitment and retention agreements, establishing joint ventures to provide inpatient rehabilitation services and long term acute care services, acquiring and divesting of health care services organizations, designing and implementing physician compensation arrangements and performing regulatory compliance reviews of existing business relationships.
