Labor and Employment Attorney Thomas R. Chibnall Joins Lowenbaum Law

Michael Lowenbaum Featured in “Rare Company,” a New Book on St. Louis Entrepreneurs

lowenbaum_042516ST, LOUIS (Sept. 8, 2016) – R. Michael Lowenbaum, founder of Lowenbaum Law, reveals what drove him to build a different kind of law firm in a just released book: “Rare Company: St. Louis Entrepreneurs and How They Got Their Start.”

“I’m the richest guy you know – and it’s got nothing to do with money,” begins chapter 2, which exclusively features Lowenbaum, the only entrepreneur in the book who started a law firm.

John Berglund, the author of “Rare Company”, said he asked Lowenbaum if he could tell his story because Lowenbaum’s success came from taking an approach contrary to every other law firm. At Lowenbaum Law, everyone is treated as if they’re partners in the business, including the assistants and paralegals.  And lawyers are not rewarded for maximizing billable hours.

“I had heard about Michael’s unusual approach,” said Berglund. “I had also heard much of his firm’s success comes from the fact that he has ‘a thousand friends’ including many of the firms’ loyal clients.”

Alert: PCOR Fees Due Aug. 1 for Self-funded Group Health Plans

The Affordable Care Act (ACA) developed the Patient Centered Outcomes Research (PCOR) Institute to improve the quality of information available to help patients, clinicians, caregivers, employers, insurers, and policy makers make informed health decisions. In order to fund the institute, the ACA imposes a fee to be paid once a year to the Internal Revenue Service (IRS). This year the due date is Aug. 1, 2016.

If your plan is fully insured, then your health insurer is responsible for paying the fee. For
self-insured plans, the employer plan sponsor is responsible for paying the PCOR fee. The PCOR fee is filed using IRS Form 720. For self-insured health plans, the fee is calculated using the average number of total lives covered by the plan (both employees and dependents).

The requirement for the calculation of the total fee is to use one of the following three calculation methods:

• Actual count method
• Snapshot method
• Form 5500 method

Plan sponsors should review all three methods to determine the lowest amount to be paid. Plan sponsors are required to use a single method per plan year, but can change the method of calculation from plan year to plan year.

The Case of He Said She Said

In a situa­tion where an employee accuses another employee of harassment and the accused denies the incident, and there are no independent witnesses or other evidence to support either employee’s version of the events, there are specific steps to take to protect yourself and the club. Michael Lowenbaum of Lowenbaum Law in St. Louis, MO, has a suggested strategy.

“Go to the alleged harasser and inform him/her that people usually don’t come forward unless a situation happened, so if someone speaks up and says that something happened, it probably did,” he explained. “Tell that employee that you are writ­ing up the situation and keeping the document so if someone else comes forward with a similar accusa­tion, disciplinary action will occur.”

 Lowenbaum also stressed the importance of maintaining documentation of any investigation.

“Next, go to the alleged victim and let her/him know that appropriate dis­ciplinary action has been taken (don’t say specifi­cally what), and then say if this happens again or if the employee experiences any retaliation, to come to you immediately.” This strategy should protect you from legal ramifications in this type of situation, Lowenbaum concluded.
